Traffic Offences

Traffic offences are typically initiated either by an Infringement Notice or through a Future Court Attendance Notice (FCAN). While these matters may seem minor, it's important to seek legal advice when facing a traffic charge, as the consequences can be more serious than many people realise.

A common misconception is that traffic matters are not serious, or that one can simply “try their luck” in court when disputing a penalty notice. However, it is crucial to understand the potential legal consequences of this approach and the proper way to respond to an infringement notice.

For example, offences under the Road Transport Act, such as negligent driving or operating a vehicle in a manner that causes a sustained loss of traction, attract fines and demerit points when dealt with through a penalty notice. However, if you elect to have the matter heard in court, the Magistrate has discretion to impose additional penalties, including a period of licence disqualification, on top of those issued by Transport for New South Wales.

At ED Legal, we have a thorough understanding of traffic law and extensive experience in representing clients in these matters. We are well-positioned to provide you with clear advice and strong representation, helping you navigate the process and pursue the best possible outcome.
